The Monrovia City Court has ordered the re-arrest of defendant Emmanuel Gonqueh, Head of the Economic Freedom Fighters of Liberia, and others for alleged bail jumping.
Judge Jallah Monday mandated the Sheriff of the court to apprehend defendant Gonqueh and others for the alleged action.
Judge Jallah’s August 16, ruling according to Freedom FM Judicial Correspondent is demanding the appearance of the defendants in court to show cause while they should not be held for bail jumping as provided by Chapter 12, Section 12.6 of the Penal Law of Liberia.
The Judge’s action was based on a submission to the Court by the Solicitor General Cllr. Syreninus Cephus after the defendants’ failure to appear in court Monday for legal proceeding consistent with Chapter 2, Section 2.4 of the Criminal Procedure Law of Liberia.
But defense lawyers led by Cllr. Jimmy Bombo took exception to Judge Jallah’s verdict against his clients, saying he will run to the Supreme Court for redress.
Prior to Judge Jumah Jallah’s August 16, decision, the defense lawyers’ application to waive preliminary examination was denied by the Court on grounds that the defendants’ offenses were cognizable before the Magisterial Court.
On August 6, the Ministry of Justice obtained a writ of arrest from the Monrovia City Court for defendant Emmanuel Gonquah and others with multiple offenses ranging from terrorist threats, simple assault, disorderly conduct, and felonious restraint.
