
The Civil Law Court has granted Circuit Courts’ Judges’ motion to include the National Legislature as a party to the Judge’s previous action against the Weah’s administration surrounding the cutting of Judges’ salaries.
Judge Kennedy Peabody Tuesday joined the lawmakers as a respondent to the case after Liberia’s Solicitor General Cllr. Syrenius Cephus conceded to the Judges’ new application.
Judge Peabody’s November 9, ruling further mandated the Clerk of the Court to issue a Writ of Summon on the National Legislature.
Our Judicial Correspondent further said that Judge Peabody’s decision has set the stage for litigation at the Civil Law Court, despite the government of Liberia’s unwillingness to a legal battle with the Judges.
About 20 Circuit Courts filed a four-count motion on October 19, to join members of the National Legislature as a party to their previous Petition for Declaratory Judgment.
The Judges’ application cited Article 34 (d) of the 1986 Constitution of Liberia as their legal reliance for the lawmakers’ inclusion which states, “The legislature to make appropriations for the fiscal governance of the Republic of Liberia”.
